DI is the company that owns and operates the following websites:
www.discointer.com (DISCO International Corporate Website, “DIC”), which is DI’s main corporate website that primarily contains information concerning DI’s corporate operations, businesses, press releases, and career opportunities. www.careerforum.net (Career Forum Net, “CFN”), which is DI’s website for candidates who are interested in attending various career forums and benefiting from DI’s career portal offerings for Japanese-English bilingual candidates who are in search of a variety of career opportunities. asian.careerforum.net (Asian Bilingual Career Forum Net, “ABCF”), which is DI’s website for candidates who are interested in attending various career forums and benefiting from DI’s career portal offerings for bilingual candidates that speak English and an Asian language other than Japanese who are in search of a variety of career opportunities. www.applyesl.com (ApplyESL.Com, (“AESL”), which is DI’s website primarily focused on assisting international applicants who are seeking to study abroad via ESL programs in both North America and the United Kingdom. ApplyESL.com includes an option for applicants benefit from a "Do-It-Yourself Study Abroad" ESL school search and application submission functionality. www.eigonorirekisho.com (English Resume.Com, “ERC”), which is DI’s website for candidates who are interested in the benefits of DI’s automated Japanese-to-English resume writing functionality.
The websites above shall be referred to herein collectively as the “DI Sites.” Purpose of DI’s Terms of Use: DI’s Terms of Use describes the binding terms and conditions you are agreeing to be bound by as a condition to initially access and, thereafter, to continue accessing the DI Sites. Purpose of DI’s Privacy Policy: DI’s Privacy Policy describes how DI treats the personally identifiable information that is collected about you (or as may be provided to us from other business about you) when you access the DI Sites.

(“DI”), which family of websites are defined as the DI Sites on DI’s Terms of Use & Privacy Policy welcome page. These pages describe the binding terms and conditions you are agreeing to be bound by as a condition to initially access and, thereafter, to continue accessing the DI Sites. If you do not agree with these General Terms of Use do not access the DI Sites. BY ACCESSING AND USING THE DI SITES, YOU ARE AGREEING TO BE LEGALLY BOUND BY THESE TERMS OF USE. PLEASE READ OUR PRIVACY POLICY CAREFULLY BEFORE BROWSING OR REGISTERING FOR THE DI SITES. Terms of Use – In General: By accessing the DI Sites, you are representing and acknowledging to DI that you have reviewed and are in agreement with these Terms of Use and the “Privacy Policy” of the DI Sites, which Privacy Policy is hereby incorporated by reference into and made part of these Terms of Use. You hereby understand and acknowledge that by accessing the DI Sites you are agreeing that these Terms of Use constitute a binding agreement between you and DI. By accessing or using the DI Sites you consent to the transfer of information to the U.S. or to any other country in which the DI Parties, their affiliates or service providers maintain facilities and you consent to the use and disclosure of information about you as described in DI’s Privacy Policy. You further represent that you are at least 18 years old (or at least the minimum legal age in the jurisdiction in which you are viewing the DI Sites which will permit you to be bound by these Terms of Use and to access the DI Sites). You may not use the DI Sites for any unlawful purpose of in violation of these Terms of Use. You also understand and agree that DI may discontinue or restrict your use of the DI Sites for any reason without notice. DI may change any term or condition in these Terms of Use or the Privacy Policy at any time without notice. The changes will appear in these Terms of Use, and your accessing of the DI Sites after any changes have been posted will constitute your agreement to all of the changes. Therefore, you should read these Terms of Use and Privacy Policy each time you access the DI Sites and before you begin using the DI Sites for the first time. You may print a copy of these Terms of Use for your reference. You understand and agree that DI may discontinue or change a portion or the entire DI Sites at any time, without notice. Businesses accessing or using the DI Sites: Unless otherwise agreed in a separate signed writing by and between DI and any business that accesses or uses the DI Sites, these Terms of Use applies equally to those businesses in all respects without limitation. Termination and Website Modification: DI may change the DI Sites, including eliminating or discontinuing any content on or feature of the DI Sites, at any time and in its sole discretion. DI may also terminate your access to and use of the DI Sites or any portion thereof, immediately, in the event DI determines, in its sole discretion, that you have breached any of the terms and conditions of this Agreement or any applicable laws, rules or regulations, or at any time for any reason without cause. Registration Information: In the event your registration is required by any or all of the DI Sites, you agree to (i) provide accurate, current and complete information about yourself as prompted by the respective service registration process, and (ii) to maintain and update your information to keep it accurate, current and complete. You may update your registration information through your account page on the applicable DI Site. As part of the registration process, you must choose a username and password. DI may refuse to grant you a username that impersonates someone else, is protected by trademark or other proprietary right law, or is vulgar or otherwise offensive, as determined by DI in its sole discretion. This agreement is personal to you and you agree not to provide access to your account or the DI Sites to any third party. You are solely responsible for maintaining the confidentiality of your username and password and for any and all activities (including purchases) that are conducted through your account. Pre-Registration Information: Due to the nature of certain portions of the DI Sites, in some cases you may be required to satisfy pre-registration requirements that may require you to submit specific information for approval prior to you being eligible to register. In such cases, your registration approval and eligibility shall be determined in DI’s sole and exclusive discretion, which approval may be withdrawn at anytime and for any reason. Notice of any pre-registration requirements will be posted in the additional terms of use for applicable DI Site for which such pre-registration requirements apply. Additional Terms of Use: You acknowledge and agree that certain additional terms of use may apply to you with respect to specific DI services furnished by or through the DI Sites. In the event you access of any DI services cause additional terms of use to apply to you, notice of those additional terms of use shall be posted in connection with the applicable DI Site that such additional terms and conditions apply. You hereby agree that all such additional terms of use shall be automatically incorporated herein and made part of these General Terms of Use and shall be subject to all of the terms and conditions herein. In the event of a conflict or inconsistency between the General Terms of Use and any additional terms and conditions, these General Terms of Use shall prevail. Fees and Credit Card Policy: Due to the nature of certain portions of the DI Sites, in some cases you may be required to pay a fee to use and access the DI Sites. DI will always notify you in advance of your obligation to pay any fees for you access or use of the DI Sites. Prior to incurring any obligation to pay new or additional fees for any portion of the DI Sites you are currently using, you will be given the opportunity to discontinue your access or use of the DI Sites prior to incurring any such payment obligations. Perpetual free access and use of the DI Sites is not guaranteed. DI reserves the right to charge fees to you for you access or use of the DI Sites. Furthermore, DI reserves the right to modify, increase or decrease such established fees in anyway and at any time. DI may process the collection of fees on behalf of certain third parties you may elect to interact with on or via the DI Sites. In the event elect to do so, you hereby authorize DI to process the collection of the applicable fees applicable to such interaction and you understand that, unless otherwise specifically stated on the applicable DI Site at the time of your election, all such fees are non-refundable for any reason whatsoever, including you desire to cancel or abandon your interaction with any third party. Fees will be billed automatically to the credit card account designated by you to DI (or to such card as you may subsequently designate to DI by furnishing updated account information). You hereby represent and warrant that the credit card information you furnish to DI is accurate and current and that you have full right and permission pay the designated application fees with such credit card. You agree to pay all fees and other charges incurred in connection with your username and password, or such other personal identifier you furnish the time of purchase, at the rates in effect when the charges were incurred. DI shall have the right to recover from you all reasonable expenses incurred in connection with collecting overdue amounts, including, but not limited to reasonable collection costs and attorney's fees. You are responsible for any fees or other charges incurred to access or use the Service through an Internet access provider or other third-party service. DI reserves the right to terminate this Agreement and your access to the DI Sites and services for any reason without cause and DI only liability therefore shall be to subsequently reimburse you for any specific fees collected by DI with respect to services not actually rendered by DI. Copyright and Limitations on Use: The content displayed on the DI Sites (the "Content") is the property of DI or its licensors and is protected by copyright and other intellectual property laws. The Content includes for example, stories, tools, calculators, RSS feeds and other items displayed on the site. The DI Sites and the Content may only be used for your personal and noncommercial use. You agree not to reproduce, create similar or derivative works from, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the Content to anyone, including, but not limited to others in the your company or organization, without the express prior written consent of DI. The DI Sites include facts, views, opinions and recommendations of individuals and organizations deemed of interest. DI and its Content licensors are not giving you personal, financial, or professional advice. DI and its Content licensors do not guarantee or warrant the accuracy, completeness or timeliness of, or otherwise endorse, these views, opinions and recommendations or advocate any personal or business decision by you. Violations of system or network security may result in civil or criminal liability. DI will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. Disclaimer or Warranties and Liability: Due to the number of sources from which content in the DI Sites is obtained, and the inherent hazards of electronic distribution, there may be delays, omissions or inaccuracies in such content and the DI Sites. THE DI PARTIES DO NOT WARRANT THAT YOUR USE OF THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS ON WHICH THE SITE IS HOSTED ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND YOUR RELIANCE THEREON. THE DI PARTIES SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY, OTHER THAN DEATH OR PERSONAL INJURY RESULTING DIRECTLY FROM USE OF THE DI SITES, CAUSED IN WHOLE OR PART BY ITS NEGLIGENCE OR CONTINGENCIES BEYOND ITS CONTROL IN PROCURING, COMPILING, INTERPRETING, REPORTING OR DELIVERING THE DI SITES AND ANY CONTENT THROUGH THE DI SITES. YOU HEREBY WAIVE ANY AND ALL RIGHTS YOU MAY NOW OR LATER HAVE TO RECOVER FROM THE DI PARTIES ANY EXPENSES, COST OR FEES INCURRED BY YOU IN RELATION TO OR ARISING FROM ANY CLAIM OR AWARD AGAINST DI IN ANYWAY, INCLUDING, BUT NOT LIMITED TO, COLLECTION COSTS AND ATTORNEY'S FEES, COSTS OR DISBURSEMENTS. Because some states or jurisdictions do not allow the exclusion or limitation of liability for damages or the exclusion of certain types of warranties, parts or all of the above limitation may not apply to you. If any applicable authority holds any portion of this section to be unenforceable, then the DI Parties' liability will be limited to the fullest possible extent permitted by applicable law. Indemnification: You agree to indemnify and hold the DI Parties, and their respective officers and employees, harmless from any claim, demand or damages (including all related third party and attorney fees, costs and disbursements) due to your violation of the terms and conditions of this Agreement or your infringement of any intellectual property or other right of any person or entity, including those that arise out of any of your “Postings” (as defined by these Terms of Use) and any material contained therein. Forums, Chat Rooms, Blogs, Videos and Other User Generated Postings; Social Networking: If you elect to post material to any blogs, forums, user-generated content submission activities, visitor or registered user comment areas, participate in our social networking channels or other community boards (collectively referred to as the “Forums”) that may be offered on our sites; or if you elect to upload any photographs, audio or video; or if you elect to respond to requests for comments or feedback, Q & A, to polls; or if you elect to furnish any type of user-generated content submission, you will be solely responsible for all content, messages, text, files, images, graphics, photos, audio clips, sounds, videos or other materials associated therewith (collectively the foregoing posts, submissions, and uploading shall be referred to as "Postings"). You agree and warrant that any Postings you post to the sites will be true and accurate, will not defame any person or invade any person's privacy, and will not infringe the proprietary rights of any person. You agree not to furnish any Postings to which you do not own the rights. The Forums are a free service provided to users of DI. By submitting a Posting in the Forums, you agree to be bound by the following terms and conditions. If you do not want to be bound by these terms, then do not use the Forums. For the avoidance of doubt, all of your activities and Postings on Forums that are hosted by third party service providers (e.g., DI’s Facebook pages, Twitter pages, etc…), shall be subject to the Terms of Use and Privacy Polices of both DI and such third party service provider. Furthermore, all information (including, personal identifiable information) contained in any Postings will be handled separately from information DI collects from you or you furnish to DI in connection with visiting or registering with DI Sites or information you elect to submit for the purpose of forwarding such specific information to a third party at your direction (e.g., potential employer or school). You hereby acknowledge and agree that by engaging in any Postings you are thereby granting DI the UGC License below with respect to such Postings. You agree to be fully responsible for your own Postings and agree to access and use the Forums at your own risk on an as-is basis. DI cannot and does not guarantee that it will post display or continue to display Postings you or other users submit to the Forum. Also, DI reserves the right to edit or abridge Postings for any reason and to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any Postings, in whole or in part, in the sole discretion of DI. You also acknowledge that visitors to the sites may post comments about your Postings which may be derogatory, and that DI has no obligation to monitor or delete any such Postings. Please be aware that DI does not and cannot monitor all of the Postings made to the DI Sites, and therefore DI will not be responsible for the content of any Postings.   • that advertise or promote any goods or services in the Forums. This includes, among other things, "junk mail", "spam", "chain letters", and "pyramid schemes;"
  • that conduct contests or distribute chain letters through the Forums; or
  • that violate any applicable local, state, national or international law in connection with your use of the Forums. This includes, among other things, any securities law or regulation.
What to do if you believe a Posting violates these Terms of Use: If you believe that a Postings in a Forum violates these Terms of Use, DI encourages you to contact DI via the following webpage messaging portal http://www.discointer.com/en/contact with a message that sufficiently identifies the applicable Posting and the screen identity of the person who made the Posting. DI cannot guarantee that any action will be taken as a result of your email. Because DI does not monitor the Postings, you agree to use and rely on them at your own risk. DI cannot and does not make any representation or warranty about the material contained in the Postings. DI likewise assumes no responsibility for any contact you may have with other users of our sites, either online or offline. If you elect to meet in person with someone you may meet on our sites, you do so at your own risk, and under no circumstances will DI be liable for any activity or injury that may occur. UGC License: As referenced in DI’s Privacy Policy, BY SUBMITTING A POSTING IN A FORUM, YOU ARE GRANTING DI A PERPETUAL, UNCONDITIONAL, ROYALTY-FREE, FULLY PAID-UP AND IRREVOCABLE RIGHT AND LICENSE TO USE, SHARE, REPRODUCE, MODIFY, ADAPT, PUBLISH, TRANSLATE, DISTRIBUTE, TRANSMIT, PUBLICLY DISPLAY, PUBLICLY PERFORM, SUBLICENSE, CREATE DERIVATIVE WORKS FROM, TRANSFER, AND SELL ANY SUCH POSTINGS. THE FOREGOING INCLUDES ALL ASPECTS OF A POSTING, SPECIFICALLY INCLUDING ANY PERSONALLY IDENTIFIABLE INFORMATION CONTAINED THEREIN for editorial or commercial purposes. In addition, without limiting the foregoing, if your Posting includes personal anecdotes, they may be attributed to you. DI can edit, rewrite, use, and reuse the content, including your name, likeness, photograph, and biographical information you provide, in any way and any media whether now known or invented in the future, with or without attribution. You agree that any content you send us will not violate any rights of any third party and that you will only send us content for which you own the rights. Links to Third Party Sites: The DI Sites contain hyperlinks to websites operated by persons other than DI. Such hyperlinks are provided for your reference and convenience only. You agree not to hold DI responsible for the content or operation of such websites. A hyperlink from the DI Sites to another website does not imply or mean that DI endorses the content on that website or the operator or operations of that site. You are solely responsible for determining the extent to which you may use any content at any other websites to which you might link from the DI Sites. Reference to any products, services, processes, hypertext links to third parties or other information by trade name, trademark, manufacturer, supplier or otherwise does not necessarily constitute or imply the endorsement, sponsorship or recommendation by DI. Product and service information of third parties are the sole responsibility of each individual third party and you agree not to look to DI for any errors or omissions or other reason with respect to such information as supplied to DI by those third parties.   • Identification of the content that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the content;

Optional Information and Functionality: AESL provides registered users the added benefit of the access and use of certain portions of AESL that are not generally available to all users. Furthermore, you understand and agree that certain portions of AESL may require additional optional information from users to ensure such areas efficiently function and in the event you decline to furnish such additional optional information those portions of AESL may not efficiently function or may not function at all. Saved Applications: AESL provides registered users the added benefit of saving their application data for each incomplete application registered users start filling out for a period of two (2) weeks so they may return to complete such applications at any time during such period. As a courtesy, AESL will send a reminder to registered users about incomplete applications prior to the end of such two (2) week period. However, it shall be the registered users sole and exclusive responsibility to pay attention to each applications’ filing deadline and to ensure all applications are completed and submitted in accordance with such deadline. AESL will deactivate each application following its deadline. Submitted Applications: AESL provides registered users the added benefit reviewing all applications submitted for a period of up to one (1) year following the submission via AESL’s “Application To-Do List” feature, but in no event shall such review period extend beyond one (1) year after the start date of the applicable course. Although schools accepting applications and non-registered users who submit applications via AESL shall not have access to AESL’s “Application To-Do List” feature, those users shall have the benefit of reviewing applications during the same time period as set forth above for registered users via a unique hyperlink for each application, which hyperlinks will be automatically sent by AESL to those users upon the submission of each application. Registered User Q&A: AESL provides registered users the added benefit of access and use of individual Q&A functionality via each registered users’ custom account page. As a courtesy reminder, AESL reminds all users that the Q&A information, including the registered user’s “user name,” may be shared with all AESL users on our public pages. You agree that AESL may select any Q&A information from the individual Q&A portion of AESL, which AESL may deem to be of interest to other AESL users, for display via AESL’s public pages. For the avoidance of doubt, all Q&A information furnished by any users shall be deemed to be Postings, as defined in DI’s General Terms of Use.
